Well it isn't in my case. That was my point.
I tried creating a new identical copy of the action that was supposed to be at the top of my list and the new one is indeed sorted correctly to the top of my list in context view.
So it looks like a bug. There's some property the old action has that causes it to be sorted incorrectly. As far as I can see, the only way they differ is in the Date Added and Date Changed.
